Employment Law changes fast at the best of times but in these unprecedented times things are changing faster than ever. Here is another change.

The Government has just announced that it will allow workers to carry over up to 4 weeks annual leave into the next two leave years.  This will apply where it is not reasonably practicable for the worker to take some, or all, of the holiday entitlement because of the Coronavirus crisis. This is less than the 5.6 weeks employees get under the Working Time Regulations. The remaining 1.6 weeks will not be affected, although this can be carried over for up to a year by agreement under the existing law.

The change is aimed at businesses that are under pressure at the moment as a result of the Coronavirus crisis and who need people at work. It aims to give those businesses the flexibility they need but also makes sure the employees don’t lose the holiday.

The Regulations dealing with this have not yet been published. Details of the announcement can be found at: https://www.gov.uk/government/news/rules-on-carrying-over-annual-leave-to-be-relaxed-to-support-key-industries-during-covid-19.
